• Upvan Gupta holds dual qualification of being a Chartered accountant and a Lawyer. He specialises in the field of direct taxes and has been working therein with leading law Firms and multinational accounting & consulting Firms for more than 8 years, including both international and domestic taxation. He has argued and assisted counsels in plethora of matters before the Tribunals and High Courts, some of which are landmark precedents in the arena.

    He has advised and argued the matters of leading foreign players at various judicial forums [Assessing Officer, CIT(A), DRP, ITAT, and High Court] on various cross border taxation issues, viz., PE formation, taxability of international secondment arrangements, withholding tax issues in international taxation, taxability of technical services, royalty, interest, dividends, professional services etc. under DTAA gamut, taxation of turnkey contracts (including offshore supplies and services), taxability of foreign oil & gas service providers in India, dispute as to set up and commencement of business of foreign retail player in India etc.

    Amongst the domestic players, he has argued and represented for leading Indian houses on some highly complex and technical issues such as allowance of deduction on grant of ESOP, availability of various deduction/ exemptions and related issues, complex withholding tax issues in case of resident payments, special audits, taxability of non-compete fees & goodwill and allowance of depreciation thereon, disallowance of expenditure incurred in relation to earning of exempt income, taxation of subsidy/ grant received from government, taxability of usance interest, deduction of profit/ turnover linked expenses for the purposes of business etc.

    He has also assisted senior counsels in landmark AAR matters and has been successfully arguing re-assessment/ revision proceedings before the income tax authorities.

    During his professional career, Upvan has gained extensive experience in advising multinational and Indian corporates on structuring their investments in India in a tax efficient manner.

    He has been instrumental in negotiating and obtaining favourable stay of demand orders and getting relief in penalty proceedings from income tax authorities at various forums. He also has experience on release of bank accounts by income-tax authorities in cases of attachment and dropping of refund adjustment proceedings. He also has good hands on experience in obtaining withholding tax orders from the tax authorities in case of payment to non-resident or resident vendors at nil or lower tax withholding rate.

    He has successfully led tax due diligence assignments in case of acquisition of Indian set ups by foreign houses.

    He has profuse experience in conducting statutory tax compliances for high stake foreign players and domestic corporate houses, including, return filings, withholding tax compliances etc.

    His contribution via valuable suggestions to the Government includes recommendations on Finance Bill 2014 and Finance Bill 2015, some of which have been accepted by the Government.

    He has been speaker on domestic & international tax issues at various seminars and budget conferences. He was a Special Invitee to the International Tax Committee of the Institute of Chartered Accountants of India (‘ICAI’) and is a Member of International Tax research group of NIRC of ICAI.
